OVERVIEW

This website is operated by Inaaya Diamonds. Throughout the site, the terms “we”, “us” and “our” refer to Inaaya Diamonds. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.

 

SECTION 1 - BINDING NATURE OF SALE & CANCELLATIONS

  • Irrevocable Orders: Due to the immediate allocation of certified gemstones and the commencement of bespoke manufacturing, all orders are final upon placement.

  • No Cancellation: We do not allow for the cancellation or modification of orders once the checkout process is complete.

  • CAD Approval: For custom commissions, your approval of the digital CAD design constitutes a final instruction to manufacture. We are not liable for aesthetic dissatisfaction if the physical piece matches the approved digital design.

SECTION 2 - SHIPPING, LEAD TIMES & RISK

  • Estimated Windows: Standard orders require up to 4 weeks and custom orders 8–10 weeks. These are estimates based on artisanal craftsmanship; Inaaya Diamonds is not liable for delays caused by production complexity or third-party logistics.

  • Signature & Authority: All shipments require an adult signature. If the Customer provides "Authority to Leave" to a courier, the Customer assumes 100% of the risk for loss or theft.

  • Transfer of Title: Ownership and risk of the goods pass to the Customer the moment the package is signed for.

SECTION 3 - COMPREHENSIVE NO-REFUND POLICY

  • Change of Mind: In accordance with luxury industry standards and the bespoke nature of our goods, Inaaya Diamonds does not offer refunds or exchanges for change of mind. This includes incorrect sizing, style preference, or perceived shipping delays.

  • The Security Ribbon: High-value items are fitted with a tamper-evident Security Ribbon. If this ribbon is cut, removed, or tampered with, the item is legally deemed "Accepted in Good Condition" and is 100% non-returnable for any reason, including claims of fault.

SECTION 4 - AUSTRALIAN CONSUMER LAW & REPAIR RIGHTS

  • Minor vs. Major Failures: In the event of a manufacturing fault, Inaaya Diamonds reserves the sole right to choose the remedy for "Minor Failures," which will strictly be a professional repair.

  • Assessment Period: We are entitled to a reasonable timeframe to inspect and assess any reported fault under 10x magnification before any remedy is offered.

  • Third-Party Voidance: Any repair, resizing, or alteration performed by a third-party jeweler immediately voids all warranties and your right to any remedy from Inaaya Diamonds.

SECTION 5 - MARKET VOLATILITY & PRODUCT ACCURACY

  • Pricing: We reserve the right to adjust pricing at any time without notice to reflect the volatility of the diamond and precious metal markets.

  • Grading Subjectivity: The Customer acknowledges that diamond grading is a subjective opinion of the laboratory (GIA/IGI). Inaaya Diamonds is not liable for minor grading variances between different laboratories.

  • Certificate Fee: Failure to return the original GIA/IGI certificate with an authorized return will result in a $350.00 AUD fee deducted from any credit or refund.

SECTION 6 - LIMITATION OF LIABILITY

  • Maximum Liability: To the fullest extent permitted by law, Inaaya Diamonds’ total liability for any claim shall not exceed the original purchase price of the item.

  • Indirect Loss: We are not liable for any consequential losses, including but not limited to, emotional distress regarding event dates, lost investment value, or third-party insurance costs.

  • Stone Loss: We are not liable for the loss of stones once the item has been delivered and signed for. We strongly recommend independent private jewelry insurance.

SECTION 7 - INTELLECTUAL PROPERTY

All bespoke designs, CAD models, and website content are the exclusive intellectual property of Inaaya Diamonds. Unauthorized reproduction of our designs will be met with legal action.

SECTION 8 - GOVERNING LAW

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of New South Wales, Australia.
